Meet Hank Stout

Hank Stout is a board-certified personal injury trial lawyer who co-founded Sutliff & Stout, Injury & Accident Law Firm and has spent his career answering one question for injured people: what is a case really worth, and how do you actually collect it. He litigates car and truck accidents, catastrophic injury, and wrongful death, and handles the kind of car accident compensation matters this book explains. Hank practices out of the firm's Houston office and has done personal injury work in the state of Texas since he was licensed in 2005.

He grew up in San Angelo, in West Texas, where his father served as a district judge before returning to practice as an attorney. That upbringing shaped his decision to study law and the plainspoken way he talks to clients. He earned his undergraduate degree at the University of Mississippi, known to most as Ole Miss, then came to Houston for his J.D. from South Texas College of Law in 2004, where he was a member of the Law Review. He has been licensed to practice in the state of Texas since 2005 and carries State Bar of Texas number 24047620.

Hank began his career on the other side of the docket, at the insurance-defense firm Phelps Dunbar, where he tried cases and learned how insurance companies evaluate and pay claims. In 2008 he and his business partner, Graham Sutliff, left their defense work to build a plaintiff's firm of their own and have run Sutliff & Stout together ever since, building a litigation-first practice that files suit early and works each case as though it is going to trial. While based in Houston, Hank represents clients across Texas, Utah, Montana, Alabama, and Florida, and the firm publishes Austin car accident guidance and resources for the Galveston coast.

Hank is Board-Certified in Personal Injury Trial Law by the Texas Board of Legal Specialization, a designation requiring a documented record of completed trials, peer review, and a written examination most personal-injury lawyers never sit for. The clearest proof of why that matters is a case he tried for a little girl whose mother was killed in a Montana 18-wheeler pileup. The at-fault driver carried only a $1 million policy, and most lawyers would have taken that money and moved on. Hank filed suit instead, ran discovery into the trucking industry and its regulations, and surfaced three additional responsible entities the first investigation had missed, turning the $1 million settlement into a multimillion-dollar trust for the orphaned child. Texas Super Lawyers has recognized him every year from 2014 through 2026, following Rising Stars selections from 2012 through 2014. He is a Fellow of the Texas Bar Foundation and a member of the Million Dollar Advocates Forum, serves on the board of the Texas Trial Lawyers Association, and belongs to the Houston Bar Association and the Houston Trial Lawyers Association.

How Texas splits the blame and the rules that decide what you can recover.

How does Texas comparative fault affect how much I can recover?

Sure. In the state of Texas we follow proportionate responsibility, so a jury weighs everyone's actions and assigns a fault percentage to each party. Your recovery is then reduced by your share. "So in Texas, if you're 40% at fault, then your overall damages, let's say it was a hundred dollars, would be reduced by $40 and you would get $60." That is the whole mechanic. And the fight over who did what is really a fight over those percentages, because they decide what walks out the door.

What is the 51% rule in a Texas car accident case?

If your share of the fault is greater than 51%, you recover nothing for your injuries in the state of Texas. Below that line, you still recover, just reduced by your percentage. There is a separate rule for pileups: as a jointly responsible party who is more than 50% at fault, you can be on the hook for all of the damages, not just your share. That is why an 18-wheeler that plows into a chain-reaction crash can be responsible for everything.

What is different about suing a government entity after a crash?

Two things change: how much you can recover and how fast you have to act. Under sovereign immunity, you cannot sue the government unless it lets you, and the Texas Tort Claims Act lets you up to a damage cap that depends on who hit you, a police vehicle, a county, or a city. The bigger trap is notice. There are specific notice provisions you must satisfy within a set timeframe. Miss that deadline and you lose the ability to make a claim at all.
